Terms of Service

1. Who you are contracting with

AEO Score (the "Service") is provided by HEKN LLC ("HEKN", "we", "us"). These Terms govern your use of the Service.

2. Acceptance

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind it.

3. The Service

AEO Score is an AI-search visibility diagnostic. Results are generated by automated analysis from the URLs and information you provide and are informational only. We do not guarantee any specific business outcome.

4. Accounts

You must provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for activity under your account.

5. Acceptable use

You must not misuse the Service. You agree not to: (a) use it unlawfully or for fraud, spam, or abuse; (b) infringe intellectual property or privacy rights; (c) probe, scan, scrape, or interfere with the security or integrity of the Service; (d) introduce malware; (e) attempt to reverse engineer, circumvent technical limits, or resell or redistribute the Service; or (f) submit URLs you do not have a right to have analysed.

6. Intellectual property

The Service, including software, content, and branding, is owned by HEKN LLC and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your subscription plan. You retain ownership of the diagnostic inputs you submit and grant us a limited license to host and process them to provide the Service.

7. Subscriptions, billing and Merchant of Record

Paid plans (currently AEO Premium at $49/month or $490/year) are billed in advance and renew automatically each billing period until cancelled. You can cancel at any time; access continues until the end of the paid period. Prices and features may change with notice; changes take effect at the next renewal.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms.

9. Service level and warranties

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that diagnostic results will be accurate or fit for any particular purpose. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

To the fullest extent permitted by law, HEKN's aggregate liability arising out of or relating to the Service is capped at the fees you paid to Paddle for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost profits, revenue, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded under applicable law.

11. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete associated data after a reasonable export window.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The state and federal courts located in Delaware will have exclusive jurisdiction, except where mandatory local law provides otherwise.

13. Changes

We may update these Terms from time to time. Material changes will be announced in the product or by email. Continued use after changes take effect constitutes acceptance.
